SC verdict on AICTE: PGDM Institutes to devise strategy at EPSI meet

In the aftermath of recent Supreme Court decision restricting AICTE role regarding MBA programmes to ‘advisory only’, PGDM institutes in India have decided to prepare a future strategy for other such cases pending in different courts.

Education Promotion Society of India, a body of higher education institutes and B-schools, has convened an interactive meeting of Chairmen and Directors of all PDGM institutes and Legal Experts on May 19, 2013 at India International Centre, New Delhi from 2.30 to 4.30 pm to devise the future strategy.

Dr H Chaturvedi, Alternate President, EPSI, said that the EPSI has been receiving several queries on the implication of SC judgment on PGDM institutions. “EPSI meet is aimed at discussing the legal implications of the SC judgment on other such cases related to PGDM institutes.”

In a major blow to AICTE, Supreme Court on April 25 had ruled that an AICTE approval is not required for private colleges running University-approved MBA programmes. A two-judge bench of Justices BS Chauhan and V Gopala Gowda had held that MBA programmes can’t be defined as technical programmes and the AICTE is not authorized to set standards as Parliament had already enacted UGC Act for the same.

The order came on a number of appeals filed by Association of Management of Private Colleges along with some other colleges which defied the AICTE order directing them to seek prior approval for starting MBA pogrammes.

The MBA institutions had argued that AICTE was wrongly interpreting its regulation which suggests that even though the University is not required to take permission from the All India Council for Technical Education, its affiliated colleges are required to do so.

“In view of such other litigation in different courts and queries received by PGDM Institutions, it is necessary that PGDM institutions join hands to put maximum efforts to get the final verdict in their favour on admission, fee, board constitution and other matters related to their autonomy,“ Dr Chaturvedi said.

He said that the PGDM institutions will also discuss on tackling AICTE move where it intends to file a review Petition on the recent SC judgement. “The meeting will take advises on legal steps that need to be taken in this regard,” he added.

Speakers who will address the meeting include Dr Pritam Singh, GD, IMI; GPC Nair, Chairman, SCMS Group; Mr Sharad Jaipuria, Chairman, Jaipuria Institutes of Management among others. Supreme Court and Delhi High Court lawyers like Naresh Kaushik, Bina Madhawan, Romi Chako will share legal perspective on the issue.
