MAH CET 2015 Result: High Court clamps stay on DTE; fixes next hearing on April 20

Bombay High Court has kindled high hopes of justice among aggrieved MAH CET 2015 takers by directing Directorate of Technical Education (DTE) Maharashtra not to proceed with MBA/MMS 2015 admission process till the decision on PILs is taken by it. The High Court of Bombay has stayed the admission process and has fixed April 20, 2015 as the next date for hearing.

 

Affected adversely by the MAH CET 2015 result due to faulty calculation of equi percentile process adopted by DTE in result declaration, candidates filed Writ petitions in Bombay High Court and its benches at Nagpur and Aurangabad. The stay order of High Court refraining DTE from going ahead with its admission plans, in view of aggrieved students is a positive sign that they will get justice. Earlier also High Court reprimanded DTE not to take the conduct of entrance exams casually as the future of thousands of candidates depend upon it. Petitioners have reposed full faith in the verdict of judiciary saying “We all strongly believe in our Judiciary System”.   

 

Bombay High court clubbed the Writ petitions and cases against the equi-percentile calculation process of DTE Maharashtra in MAH CET 2015 result, as the number was growing with each passing day while the contention was more or less same. Hearing the writ petitions, the High Court decided to continue it on Monday April 20, 2015 and till then the DTE has been directed to stop the admission process.

 

Directorate of Technical Education (DTE) Maharashtra is responsible to hold glitch free and fair MAH CET exam for admission to MBA/MMS but the DTE was not able to fulfil the aspirations of thousands of candidates. Now the decision of Bombay High Court is the last hope for the dissatisfied candidates demanding re-exam or some other acceptable solution to defuse the crisis.

 

Background of PIL

 

Directorate of Technical Education (DTE) Maharashtra conducted MAH-MBA/MMS CET 2015 on March 14 & 15, 2015 in 2 sessions on each day. Reports of technical glitches at some centres compelled DTE Maharashtra to reschedule the exam for the particular centre for next day. Another grave issue was the appearance of wrong questions and wrong answer options in the exam which made DTE Maharashtra not to evaluate 59 questions out of 800 questions in the exam.

 

To avoid any probable injustice due to existing scoring pattern, DTE Maharashtra adopted the standard equi percentile process in result declaration. To resolve the issue, DTE picked the Percentile scale of Batch II as the reference base for equi-percentile calculation while processing the MAH CET 2014 result. The reason cited by DTE for the taking the session-2 exam of March 14, 2015 as reference base is that the maximum number of 14817 candidates appeared for this batch and rest of the batches had less candidates in each session.

 

But the calculation process for equated scores as adopted by DTE created panic and confusion among the test takers as the result awarded higher percentile to low scorers and lower percentile to high scorers. The dissatisfied candidates discarded the methodology as adopted by the DTE Maharashtra in equi percentile calculation and demanded re-examination. Hundreds of the candidates contacted Dr S K Mahajan Director DTE Maharashtra, Education Minister of Govt of Maharashtra. But neither DTE nor Education Ministry agreed to hold re-exam nor they reconsidered the calculation process of awarding the percentile which caused so much anomaly.

 

With no hope for justice from DTE Maharashtra or Ministry of education who filed Caveat in the court fearing that the candidates could file Writ in the courts against DTE, the affected MAH CET 2015 test takers filed PILs in the High Court of Bombay and its other benches across Maharashtra.

 

The court has now stayed admission process and has fixed April 20, 2015 as the next hearing date asking DTE Maharashtra to place its view point.

 

So called candidates vanished

 

Few people posing as MAH CET 2015 candidates sent copied mails to top media houses like Times; HT; MBAUniverse.com & others stating that everything was fine. Surprisingly all of them pointed their guns to one genuine MAH CET 2015 test taker as if there was some personal enmity among them. MBAUniverse.com editorial team did not find the names of these so called MBA aspirants in the list of 57224 candidates who according to DTE Maharashtra took the test. Reading the articles on MBAUniverse.com site these candidates began calling the editorial team asking not to refer them as dummy candidates. When asked to share their due MAH CET 2015 identity, they failed to furnish one.

 

MBAUniverse.com published their names and mail ids to put DTE Maharashtra on alert to cross check their credentials as MAH CET 2015 test takers. However, as anticipated theslow and casual attitude of DTE Maharashtra has not allowed it to move further in the matter.
 

Aggrieved test takers in touch with experts

 

The affected candidates due to faulty equi percentile calculation process of DTE Maharashtra have conveyed to MBAUniverse.com that they IIT professors, JBIMS director, eminent experts from MBA Coaching industry have agreed upon the issue of faulty process of equi percentile calculation.

 

According to the test takers “Professors of IIT Bombay have also agreed upon wrong application of equi-percentile method. Besides, we are looking forward to get in touch with Indian Statistical Institute to get any alternative method to bring fairness in this case, say Normalization”.

 

No injustice: The only issue

 

Thousands of candidates are not satisfied with the equi percentile process adopted by DTE Maharashtra in MAH CET 2015 result. But despite their dissatisfaction these candidates would not support, adopt or pressurize any method or inappropriate way, on DTE that will adversely affect scores of any candidate of any slot of MAH MBA CET-15.
