MAH CET 2015 Result: CAP undecided with no clear instructions; Next Court hearing on April 28

Bombay High Court has given time till Tuesday April 28, 2015 to circulate copy of affidavit to all lawyers representing for MAH CET 2015 Re-Test.
The court has restricted the DTE to proceed with admission process in any of the B schools till the decision on the petitions filed on the result of MAH CET 2015 is taken

Hearing on MAH CET 2015 re-test or no retest would continue on April 28, 2015 as DTE Maharashtra in hearing dated April 23, could not present before the court the course of proposed corrective measures supposed to be implemented to rectify the anomaly in application of equi percentile process in MAH CET 2015 result across all the 4 sessions of the exam.

 

In fact petitioners demanding re-test of MAH CET 2015 were expecting directive from the court in course of hearing which began around 3.30 PM on April 23, 2015 to review the corrective measures from Directorate of Technical Education (DTE) Maharashtra to make the application of equi percentile process error free and accordingly instruct the DTE Maharashtra to take appropriate course of action. But DTE could not present such corrective measures in detail and as such Bombay High Court has decided to go for another hearing date on April 28, 2015 on the issue of application of faulty equi percentile process.

 

Students’ career: Most Important

 

The Court has upheld that it is the career of thousands of students which is most important. Hence the court has restricted the DTE to proceed with admission process in any of the B schools till the decision on the petitions filed on the result of MAH CET 2015 is taken.

 

Accordingly the Centralized Admission Process (CAP) for the MBA/MMS 2015-17 batch has been put on hold till the decision is taken by the court on the issue.

 

It is not only the issue of admissions of 57000 MAH CET 2015 test takers but many of the B schools in Maharashtra are also worried in case the decision on the issue lingers on. While the top B schools will get their take, other ones might have to run the session with more vacant seats.
 
Petitioners are hopeful that in the hearing on April 28, 2015, the High Court would take the decision on the corrective measures to give the aggrieved candidates their due. However CAP now cannot be started till the verdict on the issue is announced by the court.

 

Grave Issue: Highest scorer gets lower percentile

 

In fact Court has clubbed all the petitions on this issue of equi percentile calculation in MAH CET 2015 result. More than 57000 MAH CET 2015 test takers are affected due to the wrong application of equi percentile process. Ironically, the result of MAH CET 2015 exam has placed high scorer with 165 marks out of 200 marks at a lower percentile than the candidate with 155 out of 200 marks. It is not the equi-percentile method which is questioned but the erroneous application of the process has brought more confusion than clarity.

 

On the top of it, those who are benefitted due to this application have approached the court not to allow any retest, probably fearing to lose their position secured with the application of present equi percentile process.

 

Application of Equi Percentile: Crux of the problem

 

MAH CET 2015 was held on March 14 & 15, 2015 in 4 sessions. The erroneous appearance of questions across all the session in the exam called for rectifying measures in the result declaration. DTE Maharashtra set up a committee that found the allegations correct and as such DTE removed 59 questions out of 800 questions across 4 sessions in awarding marks to the test takers.

 

Adopting equi percentile process in result declaration, DTE thought it would end the problem. But in fact, DTE forgot that all the sessions had to be considered on equal standard in application of equi percentile process. The application of the equi percentile process by DTE created more furore than removing the erroneous questions from the relevant sessions.

 

Anomaly: High scorers demand Re-test; low scorers demand No re-test

 

DTE made the second batch exam of March 14, 2015 as its referral base for equi percentile calculation. In the process of calculation, it so happened that the candidates with higher scores in first batch got lower percentile than the candidates with lower scores in second batch who got higher percentile.

 

The revealing fact is that instead of raw scores, percentile awarded by DTE in MAH CET 2015 will be the basis of admission to the top B schools in Centralized Admission Process conducted by DTE Maharashtra.

 

Those who scored higher percentile despite scoring lower marks are not in favour of re-test for the fear of losing their rank and have filed petition against retest while those with higher score but lower percentile are in favour of re-test or some other strong corrective measures as they are confident of scoring high marks again and as such filed numerous petitions in different benches of Bombay High Court. All the petitions stand clubbed now at the stance of Bombay High Court.

 

DTE submits Affidavit

 

DTE has submitted its affidavit in response to the PIL filed against the equi percentile process in Nagpur and has stated that it is applicable to all PILs filed. Bombay High Court has given time till Tuesday April 28, 2015 to circulate copy of affidavit to all lawyers representing for MAH CET 2015 Re-Test.

 

No Admission process to begin

 

Hon'ble Bombay High court has restated that career of students is more important and has directed to halt admission process of colleges accepting MAH MBA CET 2015 score for their admission including PGDM courses and not to proceed with MAH MBA CET2015 score for preparing merit list for admission. In the hearing on April 23, 2015 all lawyers were present including from Nagpur and Aurangabad.

 

Any delay is harmful

 

Bombay High Court has already directed Directorate of Technical Education to sort out the matter of Equi percentile Application as fast as possible. Accordingly DTE was asked by the court to come prepared with the proposed measures to be taken by DTE to correct the errors in application of equi percentile process in MAH CET 2015 result. Instead of coming out with some solution to expedite the process, DTE chose to keep itself away from the hearing in High Court on April 20, 2015.

 

Since all the petitioners have full faith on Judiciary, it is expected that DTE would come up with some strong and fool proof corrective measures before the High Court on April 28, 2015.
