Supreme Court to hear EPSI Writ against AICTE PGDM-Notification 2010 today on July 19

After 7 years of continuous stay through several interim orders of the Supreme Court,Writ petition filed by EPSI against the AICTE notificationofDecember 2010 on PGDM B-schools comes up for final hearing at the Honourable Supreme Court of India on July 19, 2017.

Senior lawyer Mr Gopal Shankarnarayan will be representing EPSI and AIMS. Dr H.Chaturvedi, Alternate President, EPSI and Dr Baviskar, President, AIMS have expressed hope that the autonomy of PGDM institutions will be protected in the final hearing and verdict of the Honble Supreme Court.

AICTE for the last many years has been regulating the PGDM B-schools through its All India Council for Technical Education Approval Process Handbook thatisrevised from year to year.

Honourable Supreme Court of India in its final hearing is expected to focus primarily on the aspects and implications of the various clauses contained in this AICTE Approval process Handbook2017-18 for exampleAdmission directive to PGDM B-school instructing them not to start admission process before April 1; cap on their fee structure; curriculum framework along with other important key issues.

In December 2010, the All India Council for Technical Education (AICTE) had issued a notification to arbitrarily withdraw the autonomy of PGDM institutions. With the nationwide movement of autonomous management institutions under active leadership of the EPSI and the AIMS, these two national bodies pursued the matter at highest level including the then Union MHRD Minister MrKapilSibal .When it could not be resolved by the MHRD, PGDM institutions knocked the doors of the Honble Supreme Court. EPSI and the AIMS engaged some top notch legal luminaries in the country for pleading the case including Mr K K Venugopal,who has recently been appointed as the Solicitor General of India. Othersenior lawyers were Dr Rajiv Dhawan, Dr Abhishek Manu Singhvi, Mr Gopal Sankaranarayanan and Mr Naresh Kaushik.

During the last 7 years the apex court of India has been granting stay against the AICTE orders and instructions. PGDM B-schools are hopeful that in final hearingtoday, their pleaforautonomy of PGDM institutes, and status quo as before December 2010 upheld.

It should be remembered that PGDM B-schools were created on the lines of IIMs by MHRD, Government of India as independent Centers of Excellence. In last 50 years, B-schools like XLRI, SPJIMR, MDI, IMI, IMT, TAPMI, BIMTECH, LIBA, Jaipuriaand many others have met their promise by providing quality education to lakhs of the students.
