MAH CET 2015 Result: High Court to hear PIL today on April 20; DTE expected to soften stand

Petitioners against the equi percentile calculation process of Directorate of Technical Education (DTE) Maharashtra in MAH CET 2015 result got a shot in the arm when Bombay High Court allowed stay on their PIL on April 15, 2015 and restricted DTE from taking any action on admission process. Realizing the need of quick disposal of the PIL, Hon’ble High Court has fixed April 20, 2015 as the next date of hearing.

 

The Public Interest Litigation (PIL) with Lodging No. PIL/39/2015 came up for hearing in Bombay High Court before the bench of Hon’ble Justice V.M. Kande and Hon’ble Justice A.R. Joshi on April 15, 2015. The Court asked DTE Maharashtra to halt the admission process till the issue got sorted out. DTE Maharashtra has not officially disclosed this direction of Bombay High Court. The bench also asked DTE and aggrieved students to sort out the matter at the earliest so that the admission of candidates is not affected adversely.

 

DTE softens stand

 

Considering the gravity of the PIL and softening its stand on the issue a little, DTE Maharashtra stated in the court room on April 15, 2015 that they have been very serious on this issue since the career of more than 57000 MAH CET 2015 test takers was at stake.

 

Asking for the next date of hearing, Directorate of Technical Education (DTE) Maharashtra requested the court to proceed with all the petitions together as the cases are similar. The next date for hearing before the court was required by the Directorate of Technical Education Maharashtra to come up with necessary corrective measures to rectify the faulty application of equi percentile method.

 

To prevent any foul play in the MBA/MMS admission process due to faulty calculation of equi-percentile in MAH CET 2015, Bombay High Court put stay on the admission process till the PILs are sorted out.

 

Court directed to club all petitions to be heard at Bombay High court but since all legalities of clubbing could not be completed on April 15, 2015 and DTE also wanted time to present corrected version of equi-percentile calculation process, Hon'ble High Court of Bombay has scheduled next hearing on Monday April 20, 2015. 

 

Adamant DTE bows

 

Till the hearing date on April 15, 2015, DTE was adamant and was not ready to accept that anything wrong happened in the application of equi-percentile in MAH CET 2015 result. In view of DTE the method was correct but in hearing on April 15, 2015 before the High Court, DTE seemed to realize that application of Equi Percentile method in MAH CET 2015 result was wrong and needed corrective measures. Aggrieved candidates who filed PILs in almost all the benches of High Court of Maharashtra say “We are hopeful that they will come with corrective measures.”

 

Candidates fearing U-turn by DTE

 

Although DTE Maharashtra has been granted time till today (April 20, 2015) by the Bombay High Court to come up with corrective measures to rectify the errors in faulty application of Equi-Percentile method in MAH CET 2015 result, the aggrieved test takers are also afraid of DTE taking a U-turn despite its promise before the Bombay High Court to come up with corrective methodology to apply equi-percentile process.

 

According to the petitioner candidates “We will not be surprised on Monday by U-turn of DTE saying equi-percentile method is correct and may try to divert attention of the court towards how the method is correct”

 

To a great extent it could be true also as DTE might have bought more time from the High Court to weigh the pros and cons of the PILs and instead of coming up with some corrective measure, it might get some idea from somewhere to prove how a 155 out of 200 scorer can get a higher percentile than a 160 out of 200 scorer who has been awarded much lower percentile in MAH CET 2015 result.

 

Confident Candidates: Full faith on Judiciary

 

Despite all the odds and hardships from DTE Maharashtra by neither accepting the plea for re-exam or bringing some fool-proof equi-percentile calculation process, the petitioner candidates are confident of getting justice from Bombay High Court on the issue, saying “But we are very confident that our all efforts will be fructified. Now On Monday there will be two senior counsel lawyers representing from our side.”

 

It is expected that Bombay High Court would deliver its verdict shortly to defuse the crisis and academic session would not be delayed in Maharashtra B schools.
